Police recently arrested a New Jersey woman for allegedly driving while intoxicated. The arrest was made in the early morning hours as soon as she turned into the driveway of her own home. There were other charges including aggravated assault and resisting arrest in addition to the driving while intoxicated charge.
The arresting officer claimed he had reason to pull the woman over, although a report on the incident did not state what the reason was. He said she would not pull over until she got to her residence. When he tried to issue the initial charge against her in her driveway, he stated she tried to kick him and he added the charge of resisting arrest.
At that point, the officer apparently took the woman to the police station for booking. Upon conducting a bodily search, a second officer claims she began a physical attack and did enough damage that the officer had to be sent to the hospital for treatment. She was placed in a correctional facility with a bail of $100,000 without the possibility of a 10-percent option.
The report did not state why the officer believed the woman had been drinking, nor did it give any information on blood alcohol levels at the scene or later, when she was being processed at headquarters. It is up to the state of New Jersey to provide proof beyond a reasonable doubt that any person has been driving while intoxicated. If the prosecution cannot provide that proof, the charges against this woman may be dropped.
